STATEMENT ABOUT CASE: Defendant charged with knocking victim down on the ground and causing a fracture to her wrist. Six witnesses with some conflicting testimony, however, not one person testified (except alleged victim) that defendant touched alleged victim.

VERDICT: Not Guilty

CHARGES: Assault & Battery

STATEMENT ABOUT CASE: Defendant charged with punching victim so hard that it caused a fracture to her eye. Victim also alleged that defendant tried to choke her. Nine witnesses with some conflicting testimony, however, there was a question of credibility regarding the alleged victim. Defendant admitted hitting the victim but did so in self defense.

VERDICT: Not Guilty

CHARGES: Assault and Battery with a dangerous weapon (reduced to assault and battery at trial)

STATEMENT ABOUT CASE: Defendant charged with A & B on a pregnant woman who was visiting her relatives at the apartment complex. The two were arguing about the parking situation. A fight erupted but facts unclear about who started it and whether self defense was an issue.

VERDICT: Not Guilty

STATEMENT ABOUT CASE: Defendant charged with allowing a person to steal his motor vehicle and then pay him to burn it so could collect insurance proceeds. Principle witness against defendant was former wife who testified that she heard her former husband plan the scheme.

VERDICT: Not Guilty on all six counts (counts a, e, and f were required findings of not guilty)

CHARGES: Disorderly Person

STATEMENT ABOUT CASE: Defendant charged with causing a commotion in the parking lot and struggling with police officer who was restraining him. However, defendant claimed that police officer was upset that defendant was not listening to him and that is why he was arrested.

VERDICT: Not Guilty

CHARGES: Receiving Stolen Property, over $250.00

STATEMENT ABOUT CASE: Defendant sold camera on same day as reported stolen to a pawn shop. Evidence that she gave false address and telephone number to pawn broker.

VERDICT: Not Guilty on RSP over $250.00, however Guilty of lesser included of under $250.00. 2 years house of correction, one year to serve, balance suspended for two years. Sentence stayed to June 11, 1999. Motion t o revise and revoke filed and sentence revised to 2 years suspended for one year.

STATEMENT ABOUT CASE: Police Officer claims defendant so drunk that he need not offer Field Sobriety Test as opposed to Defendant who claims that he did not speak or understand English. Case turned on credibility.

VERDICT: (A) Not Guilty.

STATEMENT ABOUT CASE: patron of defendant’s bar claims that defendant pushed him and attacked him with a machete. Alleged victim had two witnesses who claimed to see incident. Defendant claims that he had a pending civil claim against one of the witnesses and it is a set up against him.

VERDICT: (A) Not Guilty (required finding) and (B) Not Guilty

CHARGES: (A) Drug Violation Near School and (B) Drug Distribution Class A

STATEMENT ABOUT CASE: defendant charged with selling drugs within 1000 feet on a school to a young lady. One of the police officers claimed he saw the transaction and the other officer claims he took the drugs from the young lady’s hand.

VERDICT: (A) Not Guilty and (B) Not Guilty

CHARGES: (A) OUI and (B) Marked Lanes

STATEMENT ABOUT CASE: defendant’s car went over the center guardrail separating the Northbound and Southbound lanes of Route One and landed on the Northbound side. Police arrive and smell alcohol on breath and claim he fails Field sobriety tests. The FST were given on a steep hill and defendant was dizzy after accident.

VERDICT: (A) Not Guilty and (B) Not Responsible

CHARGES: (A) assault and battery

STATEMENT ABOUT CASE: defendant, a teacher’s aid, accused of hitting a 4 year old autistic child with a pair of dungaree shorts for not cooperating and changing into swimming clothes. One teacher stated that she saw defendant forcefully and repeatedly hit child in the head. No bruises or marks on child. Alos a history of a very good relationship between child and defendant.

VERDICT: (A) Not Guilty

CHARGES: (A) OUI-Liquor (B) Leave Scene of Property Damage and (C) State Highway Traffic Violation

STATEMENT ABOUT CASE: defendant accused of OUI based on strong odor of alcohol on breath after a car accident in which she admitted that it was her fault as well as eyes being glassy and being speech being slurred. However, just prior to accident, defendant was in a brawl with a former friend and was beaten up.

VERDICT: (A) Not Guilty (B) Dismissed at beginning of trial and (C) Not Responsible

STATEMENT ABOUT CASE: Off duty FBI agent claims defendant threw a bottle of soda at victim, hit her with a scooter and shot at her with a BB gun. Alleged victim testified that these events never occurred and agent was just upset about her boyfriend/defendant littering in front of his house.

VERDICT: (A) Not Guilty (B) Not Guilty (C) Not Guilty (D) Dismissed just before trial by Judge
