DATE OF TRIAL: October 23 ‑ 31, 1991
CHARGES: Armed Assault in a dwelling (4 counts), Armed Robbery (2 counts), driving to endanger and unlawfully carrying a gun
STATEMENT ABOUT CASE: Four eyewitnesses claim that defendant entered home with a gun, pistol whipped one person and took money from two. Cross examination showed enough inconsistencies with identification issue to obtain not guilty, however, no dispute that defendant was driver of motor vehicle and gun was thrown from car.
VERDICT: Not Guilty on all the six major counts of Armed Assault and Armed Robbery, Guilty on the driving to endanger and unlawfully carrying a gun charge.

DATE OF TRIAL: January 8 ‑ 10, 1992
CHARGES: Trafficking Cocaine over 28 grams and conspiracy to violate narcotic laws
STATEMENT ABOUT CASE: Three police on a surveillance claim that defendant delivered drugs to his son’s home via a jeep. Informant claims that he was told to return when jeep arrived in order to purchase drugs.
VERDICT: Not Guilty (motion for required finding of not guilty was allowed by Judge at the conclusion of the Commonwealth’s case.

DATE OF TRIAL: October 2, 1992
CHARGES: Carrying a firearm without a license
STATEMENT ABOUT CASE: Police stopped defendant’s car on Halloween, 1990 and in a duffel bag found a gun along with other weapons. However, only charge brought against defendant was the carrying a firearm under C.269 sec. 10(a) [all other charges were either dismissed, no probable cause found or just not included as part of indictment]. Case was jury waived and conducted as a bench trial.
VERDICT: Not Guilty of carrying a firearm without a license. However, guilty of possession under C.269 sec 10(h). Judge imposed a suspended sentence.

CHARGES: Possession of Class “A” (Heroin) substance with intent to distribute
STATEMENT ABOUT CASE:Defendant accused of delivering the heroin in his car to two suspected heroin dealers. Police testified that he believed a drug transaction occurred in car based on his observations.
VERDICT: Not Guilty

CHARGES: (a) Trafficking over 200 grams of Class “B” (b) Trafficking over 200 grams of Class “B” and (c) Conspiracy
STATEMENT ABOUT CASE: Defendant accused of being a major drug distributor in the Lowell area and with the cooperation of an undercover informant wearing a microphone and the police in an undercover surveillance van filming as much as possible, alleged that defendant was involved in trafficking one kilogram of cocaine in Lowell and three kilograms in Dracut along with two other co‑defendants.
VERDICT: (a) Not Guilty (three kilograms in Dracut), (b) Guilty (One Kilogram in Lowell) and (C) filed without a change of plea (by Judge after trial)

CHARGES: (a) Armed Assault in a dwelling (3 counts) (b) Armed robbery
STATEMENT ABOUT CASE: Defendant accused of breaking into an apartment with 2 other suspects and robbing victims of money and jewelry. Identification was a crucial issue. Defendant had an Alibi defense.
VERDICT: Not Guilty on all counts.

STATEMENT ABOUT CASE: Defendant accused of robbing a convenience store with a gun while masked. Video was inconclusive regarding his identity. Also, a signed confession with respect to defendant’s participation; issue for jury was whether defendant signed this confession voluntarily.

STATEMENT ABOUT CASE: Defendant accused via a joint venture of crushing the skull of victim as well as kicking him while he was unconscious.

STATEMENT ABOUT CASE: Defendant accused of lying at a motion for a new trial regarding a murder case along with three other defendants. Commonwealth contends that it was a conspiracy and that all four defendants engaged in perjury. The other three defendants were found guilty.

STATEMENT ABOUT CASE: Defendant was chased through several back yards and caught by Lynn Police. In his pocket was a key to a stolen motor vehicle and $590 in cash. Key fit a nearby reported stolen motor vehicle and an alleged victim reported that his car was broken into and $590 was missing. Defendant took the stand and testified that he borrowed the vehicle from an acquaintance and did not know that it was stolen. The $590 in his pocket was given to him by alleged victim regarding drugs.
VERDICT: (a) Not Guilty (b) Not Guilty (c) Not Guilty and (d) nolle prossed after the not guilty verdicts were announced

STATEMENT ABOUT CASE: defendant accused of threatening a prosecution witness who was about to testify at a Grand Jury investigation. Alleged Victim and her sister in law claim defendant threatened to kill victim. Victim and her sister in law had different versions of event which affected their credibility.
